Abstract

In this paper we will build on our AHRC funded project on Mapping Grey Areas in International Legal Approaches to The Failure of Crypto Firms as well as Prof Moffatt’s report with Prof Dominik Skauradszun on Crypto-assets in Restructuring and Insolvency, which was prepared for the Conference on European Insolvency and Restructuring Law, ‘CERIL’.. The paper builds on one of the recommendations made by participants at the AHRC project’s August workshop for the development of guidelines for practitioners. These guidelines would include the characterisation of cryptoassets, asset-backed stablecoins and unbacked tokens including memecoins such as Dogecoin and Pepe, and utility tokens. We provide a starting point for these guidelines by de-mistifying the concepts and relevant procedures. Appendices provide greater conceptualisation as well as a glossary.
